NO PURCHASE NECESSARY TO ENTER OR WIN IN THE “KNOW IT OR BLOW IT” INSTANT WIN GAME (“INSTANT WIN GAME”).
ENTRY INTO THIS INSTANT WIN GAME CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.
INSTANT WIN GAME BEGINS AT 9:00 A.M. ET ON August 17, 2020 AND ENDS AT 12:00:00 P.M. ET ON October 31, 2020 (“PLAY PERIOD”).
WHO MAY ENTER: Instant Win Game is open to legal residents of the 50 United States (including the District of Columbia) age 18 or older at time of entry and who have downloaded the free “Know It or Blow It” App (“App”).
Employees (and their immediate families [spouse, parent, child, sibling and their respective spouses], regardless of where they reside or those living in the same households, whether or not related) of TyMedia Productions, LLC (the “Sponsor”) and its respective parent companies, affiliates, subsidiaries, prize supplier(s), content provider partners, mobile competitors, distributors, agent(s) and advertising, marketing and promotion agencies (collectively, the “Game Parties”) are not eligible to enter or win. Each player is eligible for one prize within a 30-day period. If a second claim is submitted by a recent prize claim winner within thirty days of the former claim, the Sponsor will contact the player to inform him or her of the inability to claim the second prize. By participating in the Instant Win Game, each player represents and warrants that he or she meets the eligibility requirements stated in these Official Rules and acknowledges that failure to meet all eligibility requirements will disqualify participant. Instant Win Game is subject to all federal, state and local laws and regulations. Void where prohibited by law.
HOW TO PLAY FOR A CHANCE TO WIN:
Download the free App and create a profile to become a “player”. After you create a profile, you automatically receive 50,000 coins that can be used to play for free and advance on the App’s leaderboard. If during any App game play you play on a winning date/time or immediately after a winning date/time, you will receive the item shown on the screen. A player is not a winner of any instant win prize until player’s eligibility and the potential winning instant win game play has been verified by Sponsor and/or its agent. A screenshot is not proof or evidence of winning instantly. If your screen does not display an instant win prize-winning message, you are not an instant win prize winner. Receipt of a game play occurs when the server hosting the App records the submission resulting from playing on a winning date/time (collectively referred to hereafter as an “instant win game play”). In the case where multiple instant win game plays are submitted at the same winning date and time, the first instant win game play received will be verified as the potential instant win prize winner Your confirmation as the instant win prize winner is subject to verification and meeting eligibility requirements in these Official Rules. All instant win game prize claims must be received by 11:59:59 PM ET on October 31, 2020. If you receive a potential winning instant win prize message, you must hit the ‘Claim’ button, which will take you to a page with instructions on how to claim prize.
ODDS:
Odds of winning an instant win prize depend upon whether your instant win game play occurs at or immediately after one of the randomly-generated winning instant win date/time during the Game’s Play Period.
UNCLAIMED PRIZE(S) WILL NOT BE AWARDED.
Sponsor reserves the right to refuse or deny any instant win game play to any player it feels does not meet the eligibility qualifications stated in these Official Rules. No more or less than the authorized number of prizes will be awarded, according to these Official Rules.
HOW TO CLAIM AN INSTANT WIN PRIZE: To claim an instant win prize, potential winner may need to execute Affidavit of Eligibility/Publicity Release or any required document mandated by Sponsor, which must be completed, signed and received by Sponsor or its agent by the deadline date on notification. Upon completing any required document and verification of eligibility by Sponsor and/or its agent, the prize will be provided to winner. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from [1] potential winner’s failure to provide the Sponsor and/or its agent with satisfactory proof of age, identity and residency; [2] potential winner’s failure to validly claim the prize by deadline on a prize notification, and [3] any other non-compliance with Official Rules. Should a winner make any false statement(s) in any document required by Sponsor, that winner will be disqualified and required to promptly return to Sponsor his/her prize. If a winner is disqualified for any reason, at Sponsor’s sole discretion, the prize will be forfeited.

ARV of all prizes (if claimed): $5,000.00. No substitution for prize won, except by the Sponsor who reserves the right, in its sole discretion, to substitute any prize with a different prize of comparable value. Prizes are not transferable or redeemable for cash; a winner is not a recipient of prize until he/she has been verified by Sponsor and/or its agent. Prize details are at Sponsor’s sole discretion. Winners acknowledge the Sponsor does not make, nor is in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions or fitness of any aspects of any merchandise prize except the prize is subject to its manufacturer’s standard warranty, if any.
GENERAL CONDITIONS: Winning constitutes permission (except where prohibited by law) to use each winner’s name, photograph, hometown, likeness, and prize won (all at Sponsor’s discretion) for future advertising and/or publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification, release, or permission.
SUSPENSION / MODIFICATION / TERMINATION: In the event the Game Parties are prevented from continuing with the Instant Win Game by any event beyond their control, the Sponsor shall have the right to suspend or terminate the Instant Win Game and not to award any unclaimed instant win prize. The Sponsor reserves the right to modify, suspend or terminate the Instant Win Game if it is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or any Force Majeure event(s) has destroyed or severely undermined or impaired the integrity and/or feasibility of the Instant Win Game.
MISCELLANEOUS CONDITIONS: By participating players (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and/or its agent, which are final and binding in all matters relating to the Instant Win Game. Failure to comply with these Official Rules will result in disqualification. Sponsor reserves the right to permanently disqualify and delete the account of any person it believes has intentionally violated these Official Rules.
RELEASES: By playing, players agree to release and hold harmless the Game Parties from all claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Instant Win Game or acceptance or use of prize (if player wins a prize), the substitution of prize in accordance with these Official Rules, the administration of the Instant Win Game, a player’s breach of Official Rules or Sponsor’s use of any of the rights granted herein.
Privacy: Information collected from player is subject to App’s Terms of Use and Sponsor’s Privacy Policy located at: https://tymedia1.wpcomstaging.com. Any requested opt-in consent is not required and will not increase your chances of winning.
Arbitration and Choice of Law: Except where prohibited by law, as a condition of participating in this Instant Win Game, player agrees that (1) any and all disputes and causes of action arising out of or connected with this Instant Win Game, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest New Orleans, Louisiana; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will player be permitted to obtain awards for, and player hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than player’s actual out-of-pocket expenses (i.e., costs associated with entering this Instant Win Game), and player further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of players and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Louisiana, USA without regard to Louisiana choice of law rules.
